1. Definitions
In these Terms of Service (hereinafter referred to as 'Terms'): 'Wmax', 'we', 'us', 'our' refer to Wmax Broker Ltd, registered in the Union of the Comoros, company number 15936, holding AOFA license L15936/WMB; 'Client', 'you', 'your' refer to any natural or legal person who registers and opens a trading account on the Wmax platform; 'Platform' refers to the wmax.com website, MetaTrader 5 terminal, and related trading facilities owned by Wmax; 'Services' refer to the contracts for difference (CFD) brokerage, market data subscriptions, deposit and withdrawal settlement, and other business provided by the Company.
2. Scope of Application
These Terms apply to all clients who open an account and trade through the Wmax platform. By registering for a platform account, you acknowledge that you have read, understood, and agreed to all terms herein. If you do not agree to any term, please immediately cease using the Services. These Terms should be read in conjunction with the Risk Disclosure Statement and Privacy Policy.
3. Account Opening
You must be at least 18 years old, have full legal capacity, and not be a resident or citizen of the Company's restricted service areas (United States, North Korea, Iran, Syria, Cuba, Crimea, Donetsk, and Luhansk regions). Account opening requires completion of KYC identity verification, including but not limited to a government-issued photo ID, proof of address, and financial status declaration. All information must be true, complete, and up-to-date; any changes must be notified to the Company within 30 days. The Company reserves the right to reject or close any account without providing a reason.
4. Services
The Services provided by the Company include but are not limited to: Contracts for Difference (CFD) trading (covering forex, precious metals, indices, energy, cryptocurrencies, etc.); market quotes and technical indicator subscriptions; fund deposit and withdrawal services; MT5 platform and related trading tools; client education and market research content. The Company does not provide any form of personalized investment advice, guaranteed return plans, or discretionary account management services.
5. Rights and Obligations
Company Obligations:(1) Provide a stable and reliable trading platform and quotes; (2) Segregate client funds in Tier-1 bank client money trust accounts; (3) Comply with AOFA regulatory requirements and AML/CFT standards; (4) Protect client personal data and transaction records.
Client Obligations:(1) Safely safeguard account passwords and two-factor authentication devices; (2) Bear all consequences of their own trading decisions; (3) Refrain from market manipulation, money laundering, fraud, or other illegal activities; (4) Not use automated trading scripts without the Company's written consent to exploit platform vulnerabilities for profit; (5) Pay any applicable fees on time as required.
6. Account Termination
You may request to close your account at any time via the Member Center or by email. The Company may unilaterally terminate an account under the following circumstances: (1) Client breaches these Terms; (2) Client provides false information; (3) Court or regulatory authority order; (4) No trading or login activity for 12 consecutive months; (5) Client's identity or region changes significantly, rendering the Services no longer applicable. After account termination, any remaining available funds will be returned via the original deposit method within 14 business days after KYC confirmation.
7. Dispute Resolution
If you have any disputes regarding your account, trading, deposits/withdrawals, or platform operations, please contact us first via support@wmax.com . The Company will respond within 5 business days and make every effort to negotiate. If negotiation fails, you may file a complaint with compliance@wmax.com for a secondary review by the compliance department. The Company does not accept complaints through social media or third-party platforms. All disputes shall be finally determined based on the Company's settlement system records.
8. Governing Law
These Terms are governed by the laws of the Union of the Comoros. Any dispute arising from or related to these Terms shall be submitted to the competent courts of the Union of the Comoros; however, the Company reserves the right to initiate proceedings in the client's jurisdiction. If any provision of these Terms is found to be invalid or unenforceable by a court, the remaining provisions shall remain in full force and effect. The latest version of these Terms shall prevail as posted on this website. The Company reserves the right to revise them at any time; material changes will be announced on the website and notified to clients via email 30 days before the effective date.
